Mistakes in Judgment

All professionals are called upon to make judgments based on their knowledge and experience. Many professional judgments involve trade-offs where any choice made will have potential benefits and burdens, and the question becomes, “What is the best combination of risks and benefits?” Courts are very reluctant to second-guess judgments chosen from reasonable alternatives, even when, in retrospect, it might have been seen that another judgment would have been preferable. Accountant judgment cases can be won, but only when it can be shown that the judgment was so far out of the bounds of acceptable choices that it ceased to be a real “judgment” at all.
